Terms of Service

1. Acceptance of Terms

By accessing or placing an order through the Vivdrop website (vivdrop.com, the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all Terms, you may not use the Site or purchase products. These Terms apply to all visitors, customers, and others who access or use the Site.

Vivdrop is operated as a sole proprietor / small business under applicable law. By purchasing from us you confirm you are at least 18 years of age, or that you are the parent or legal guardian supervising a minor who is using the Site.

2. Custom-Print Products — Your Responsibility

Vivdrop is a print-on-demand service. You design and submit artwork; we print it onto blank apparel. You bear sole responsibility for all content you upload or create using our design editor.

• Copyright & Intellectual Property: By submitting artwork you represent and warrant that you are the original creator, or that you have obtained all necessary rights, licenses, consents, and permissions to use the work for commercial reproduction on merchandise. You must not submit artwork that infringes any third-party copyright, trademark, patent, trade secret, right of publicity, or any other proprietary right.
• Prohibited Content: You may not submit artwork that is defamatory, obscene, sexually explicit involving minors, threatening, harassing, or that promotes or glorifies illegal activity, violence, terrorism, or hate against any group of people based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
• Indemnification: You agree to indemnify, defend, and hold harmless Vivdrop and its owners, employees, and agents from any claim, liability, cost, or expense (including reasonable attorney's fees) arising out of your uploaded content or your breach of these Terms.
• Our Right to Refuse: We reserve the right, at our sole discretion, to refuse to print any design we deem inappropriate, infringing, or in violation of these Terms without prior notice and without refund if the order has not yet been printed. If we detect a violation before printing, we will issue a full refund.

3. Orders & Payment

• Order Confirmation: Placing an order constitutes an offer to purchase. We reserve the right to decline or cancel any order, including in cases of pricing errors, suspected fraud, or inability to fulfill.
• Pricing: All prices are in US dollars and do not include applicable taxes and shipping unless stated. Prices may change at any time; changes do not affect orders already accepted.
• Payment Processing: Payments are processed securely by Stripe, Inc. Vivdrop does not store your payment card details. By submitting a payment, you also agree to Stripe's Terms of Service (stripe.com/legal).
• Taxes: You are responsible for all applicable taxes. Vivdrop will collect sales tax where required by law.
• Chargebacks & Disputes: Filing a fraudulent chargeback for a legitimately fulfilled order is considered fraud. We retain the right to pursue recovery of funds and report such activity to relevant authorities.

4. Production & Shipping

• Production Time: Orders are typically printed within 1–3 business days of payment confirmation. Production times are estimates and are not guaranteed.
• Shipping Times: Shipping estimates (3–7 business days for standard US shipping) begin once the order leaves our facility and are provided by carriers. We are not responsible for carrier delays, weather events, customs holds, or any other factors outside our control.
• Tracking: A tracking number will be provided via email once your order ships. Vivdrop is not responsible for packages that are lost, stolen, or damaged by the carrier after leaving our facility. In such cases you must file a claim with the carrier.
• Address Accuracy: You are responsible for providing an accurate and complete shipping address. Orders shipped to an incorrect address provided by the customer will not be reprinted or refunded.
• International Shipping: For international orders, you are responsible for all customs duties, taxes, and import fees. We are not liable for delays or seizures at customs.

5. Returns, Refunds & Replacements

Because every order is custom-printed specifically for you, all sales are final.We do not accept returns or exchanges based on customer preference, including wrong size ordered, change of mind, or design errors made by the customer.

We will, however, offer a free reprint or a full refund if:

• The item arrives with a clear manufacturing defect (e.g., print misalignment, wrong item, ink bleed).
• The item is significantly different from what was ordered due to our error.
• The item is lost in transit and not delivered within 30 days of ship date.

To be eligible for a reprint or refund, you must contact us within 7 days of delivery(or 7 days after the expected delivery date if not delivered) with a clear photo of the issue and your order number. We reserve the right to determine whether a defect qualifies under this policy.

Color variations between your screen preview and the printed product are not considered defects. All screens are calibrated differently, and printed colors will vary. We note this clearly on every product page.

6. Color Accuracy Disclaimer

DTF printing is a high-quality process, but we cannot guarantee exact color matching between your screen and the final printed product. Factors include:

• Monitor calibration differences between your device and our production equipment.
• Natural variation between fabric dye lots.
• Heather fabrics printing differently than solid fabrics — texture will show through.
• Garment-dyed blanks absorbing ink differently due to their pigment-dye base.
• Dark garments may affect the perceived color of light-colored elements in the print.

By placing an order, you acknowledge these limitations and waive the right to a refund based solely on color variation.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIVDROP AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR ANY PURCHASE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM.

8. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. VIVDROP DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

9. Digital Millennium Copyright Act (DMCA)

Vivdrop respects intellectual property rights. If you believe content on our Site or any customer-submitted design infringes your copyright, please see our DMCA Policy for instructions on filing a takedown notice.

10. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• Notify us immediately of any unauthorized use of your account.
• We reserve the right to terminate accounts for violation of these Terms.

11. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States and the applicable state law where Vivdrop operates, without regard to conflict of law provisions.

Any dispute arising out of or relating to these Terms or any purchase shall first be submitted to informal negotiation. If unresolved within 30 days, it shall be submitted to binding arbitration in accordance with the American Arbitration Association rules.

You agree to waive any right to participate in class-action lawsuits against Vivdrop.

12. Changes to These Terms

We reserve the right to update these Terms at any time. The date at the top of this page reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the new Terms.
