DMCA Policy

1. Our Commitment to Copyright
Vivdrop respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. § 512, we will respond expeditiously to valid claims of copyright infringement. We have a policy of terminating accounts of users who are repeat infringers.
As a print-on-demand platform, Vivdrop does not pre-screen customer-submitted artwork. We provide customers with tools to create designs and we print what they submit. We therefore cannot guarantee that all submitted designs are free from copyright infringement. However, upon receiving a valid DMCA takedown notice, we will act promptly.
2. How to Submit a DMCA Takedown Notice
If you believe that material hosted on or linked to from vivdrop.com infringes your copyright, you may submit a written DMCA takedown notice to our Designated Agent. Your notice must include all of the following elements under 17 U.S.C. § 512(c)(3):
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notice, a representative list is acceptable.
- Identification of the infringing material and information reasonably sufficient to permit us to locate it on the Site (e.g., specific URL or order number, if known).
- Your name, address, telephone number, and email address so we can contact you.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

We may request additional information before processing the notice. Incomplete notices may be disregarded.
3. What Happens After We Receive a Valid Notice
- We will review the notice and, if valid and complete, take the following steps within 5 business days:
- Remove or disable access to the allegedly infringing material.
- Notify the user who submitted the design of the takedown.
- Retain a record of the notice for our legal files.
If an order has already been printed and shipped, we cannot reverse the physical shipment. However, we will prevent future printing of the same design and may take action against the customer's account.
4. Counter-Notice Procedure (DMCA § 512(g))
If you believe that material we removed was not infringing, or that you have authorization to use the material, you may file a DMCA counter-notice. Your counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the US, any judicial district in which Vivdrop may be found), and that you will accept service of process from the person who provided the original notice.

Upon receiving a valid counter-notice, we will forward it to the original complainant and restore the material within 10–14 business days unless the complainant files a court action.
5. Repeat Infringer Policy
Vivdrop reserves the right, at its sole discretion, to terminate the account of any user who repeatedly submits infringing content. A user may be considered a repeat infringer if we receive two or more valid DMCA complaints regarding their submitted designs.
6. Misrepresentation Warning
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including attorney's fees. Please ensure your notice is accurate before submitting.
7. Trademark Concerns
This DMCA policy governs copyright infringement. For trademark infringement concerns, please contact us at legal@vivdrop.com with a description of the mark, evidence of your ownership, and the specific content you believe infringes your trademark.
